CRIME WATCH: Crime Watch should be up and running the first week in November. We seem to have gotten complacent the last few years and are not getting the sign ups that we need to make the program work. If everyone signed up twice a season we'd fill all the scheduled evenings. We lost one base operator this year and will need one to replace her.

Remember --- This is a voluntary program and that means it needs volunteers to make it work.

                              REMEMBER SOCIAL CLUB MEETING TUESDAY,                                                                   NOVEMBER 2, 2004 at 7:00 P.M.                                                    A special treat of ice cream and trimmings and cake will follow the meeting.

TRAVEL NEWS: Watch the bulletin board for trips and events. Also you may check with Mary K at 365-1131 for additional information.

BOWLING LEAGUE: Our league play began on October 20th, we had 15 bowlers and a good time was had by all. If you want to bowl or be a substitute, contact Doug or Sue Rice at 787-2292.

The Good Sams Club would appreciate your cooperation when we have a funeral meal to prepare. A notice announcing the arrangements for services, fellowship and meals will be posted in the Club House on the bulletin board as soon as we have the information to pass onto the park residents. Please use the sign up sheets. We must know the number of people who plan to attend said function. We can then be prepared to make the fellowship memory more comfortable for the bereaved.

                 THE WATER AEROBICS CLASS WILL BEGIN AT 10:00 A.M.                                                  IN NOVEMBER, BE THERE FOR LOTS OF FUN                                                                  AND HOPEFULLY SOME FIRMING TOO!

Special thanks to Barb and Rob Spencer for cleaning up the storm debris in the boat ramp. It was really a smelly mess after the visits from the hurricanes. Good Job Folks. We really appreciate your efforts.

Ruby Cribb would like to thank all her friends and neighbors for all their kindness, cards, prayers and visits while she has been ill. Everyone's concern is much appreciated along with the food and other goodies that have been shared. Ruby even mentioned the fact that she was grateful for the spot under the piano bench at the shelter while waiting for Charley to pass by.

Ruby is a special lady and we wish her well and also thank her for her gift to the Social Club of a handmade map of the USA for use in identifying the home states of the members of our community. Check it out in the Clubhouse!

FYI: Have you noticed our community is somewhat darker these nights? The problem is that we have several security light poles that have burned out bulbs in them or possibly some other problem. The Electric Department handles these repairs. If you have a security light pole on your lot that is not working you can call 728-9830 and report it. Be sure to include the pole number, that is located at eye level on all poles. Please help to make our community safe by reporting any security lights that are not working.

With George and Gini Langs departure to points west earlier this year Lynne and I have been asked to take over the co-ordinating of the parks Christmas decorating activities. This includes decorating the park, November 29, 2004 (commencing at 9:00 AM) and the "Chili Light Up Dinner", December 7th. 2004 (commencing at 6:00 PM) prior to the meeting of the Social Club

As Lynne and I are rookies at this project we would greatly appreciate some knowledgeable volunteers to establish a committee to ensure that ,we cover all the bases. Volunteers will also be needed to assist with the park decorating and the "Chili Light Up Dinner" preparations.

We will be returning to our home in Lakeside Terrace the last week of October and are very much looking forward to seeing all or our friends there. We can be reached at 1 Clubhouse Drive or 365-4374.

Good Neighbor Gang

The Good Neighbor Gang has welcomed thirty new residents so far in 2004. These ladies deliver a small packet of information to all newcomers and welcome them to the community. Let us all be good neighbors and be of help where ever we can and invite newcomers to our many functions and help them get acquainted. We have a great place to live and we look forward to greeting all the new faces and listening to fresh ideas to make this an even better place to call home.

FROM THE MANAGERS:

We are sure that everyone by now has noticed the changes in the community that Hometown America has done this year:

Relandscaped the entrance
New telescoping flagpoles at the Community Center
New chairs at the poolside.
New Street signs throughout the community, that are reflective.

Along with this we have been working on replacing the spa with a newer more efficent one. We have run into a snag, the regulations have changed on the commercial spas requirements this year. We will let you know as soon as we can with any update on this. We thank you in advance for your patience.

Please remember, that any comments or suggestions for the management or Hometown America can be written on the forms located on the wall next to the kitchen that says" Manager's Notes", then deposited into the rent drop box on the Managers Office door. Thank you for all the great compliments on what has been done this year.

We have been informed of the passing of Pat Buchanan who was a prior resident of the park. She and her husband Ted were from Canada and will be remembered by several of the residents. Ted Buchanan can be contacted at 8302 Racey Avenue, Niagara Falls, Ont, Can L2H 3M7.

If you would like your birthday and/or anniversary date known and put in the newsletter and on the bulletin board in the clubhouse; please drop a note with the information into the Seagull Soundings Blue Box in the clubhouse. We will be glad to mention those special days for you.

FLORIDA STATUTE 723.022      Mobile home park owner's General Obligations-A mobile home park owner shall at all times: (5) comply with properly promulgated park rules and regulations and require other persons on the premises with his or her consent to comply therewith; etc.

FMO LEGAL COUNSEL Justin Joseph in     FMO Magazine Sept/Oct 2004 pg. 15 Q: The owners and/or managers of our park refuse to comply with our prospectus. What course can we take? A: The prospectus is a disclosure document, which by statute acts as a contract between the park owner and the resident. A violation of the prospectus can serve as a basis for a breach of contract action in which the resident would file a civil law suit against the park owner for breach of that contractual obligation. Additionally, a park resident could involve the Division of Florida land Sales, Condominiums and Mobile Homes to investigate any violation of the prospectus, and under Florida Statute 723.006(5) would allow that Division to institute any type of enforcement proceedings in it's own name for a violation of the prospectus.

The current and previous owners of this park are not "tenant friendly". They have not enforced any rules, even when proper complaints have been filed, and have no intention of honoring the prospectus! They have in fact, encouraged violation of the rules by recruiting residents to work out of their homes as sales representatives. In one case for several years. We are paying for the protections in our contract and are not getting them. This is a clear case of taking our money under FALSE PRETENSES.

The park owners have shown they do not respect the residents by failing to appear at the last two home owners annual meetings. The resident manager did not appear at the last one either. These people need to face up to their responsibilities to us!

The entire Florida Statute 723 can be found on-line. I have complaint forms.
